STANDARD TERMS AND CONDITIONS OF SALE
1. DEFINITIONS AND INTERPRETATION
For the purpose of these Terms and Conditions (“Terms”), the following words shall have the meanings assigned to them below unless the context indicates otherwise:
a) “Business Day”
Any day excluding Sundays, and official public holidays in the Republic of South Africa.
b) “Call-Out Form”
A document used to schedule and authorize on-site repair, maintenance, inspection, or installation services by a technician.
c) “TM Catering Equipment and Services Pty Ltd”
Refers to TM Catering Equipment and Services Pty Ltd, including its directors, employees, representatives, agents, contractors, and successors.
d) “Customer”
Any individual, business, company, trust, close corporation, or entity purchasing goods or services from TM Catering Equipment and Services Pty Ltd.
e) “High-Risk Area”
Any location identified by TM Catering Equipment and Services Pty Ltd as unsafe or dangerous for deliveries or service visits due to crime risks or safety concerns.
f) “EFT”
Electronic Funds Transfer.
g) “Force Majeure”
Any event beyond the reasonable control of the company, including but not limited to natural disasters, riots, strikes, war, pandemics, government restrictions, supplier failures, or civil unrest.
h) “Goods”
All catering equipment, machinery, parts, accessories, products, or items sold or supplied by TM Catering Equipment and Services Pty Ltd.
i) “Warranty” / “Guarantee”
The applicable warranty period and conditions under which faulty goods may be repaired or replaced.
j) “Invoice”
The official tax invoice issued for goods or services supplied.
k) “Order”
Any request made by the Customer for the purchase of goods or services, whether verbal, written, electronic, online, or in-store.
l) “Original Packaging”
The original packaging supplied with the goods, including manuals, accessories, and related documentation.
m) “POPIA”
The Protection of Personal Information Act 4 of 2013.
n) “Sales Order”
The written or electronic confirmation issued by TM Catering Equipment and Services Pty Ltd confirming acceptance of an order.
o) “Terms and Conditions”
This document and any amendments made to it from time to time.
p) “Website”
The official website and online platforms operated by TM Catering Equipment and Services Pty Ltd.
APPLICATION OF THESE TERMS
- These Terms apply to all quotations, sales, repairs, maintenance services, and transactions conducted by TM Catering Equipment and Services Pty Ltd.
- By placing an order or making a purchase, the Customer agrees to be bound by these Terms and Conditions.
- The latest version published on the company website shall apply at the time the order is placed.

PRODUCTS AND AVAILABILITY

ORDERS AND ACCEPTANCE
- Orders may be placed online, via email, WhatsApp, telephone, or in-store.
- An order shall only become binding once accepted by TM Catering Equipment and Services Pty Ltd through the issuing of an Invoice or Sales Order.
- The company reserves the right to decline or cancel any order due to stock shortages, pricing errors, payment issues, or any other reasonable commercial grounds.
PAYMENT TERMS
- Full payment must be received before any goods are dispatched or collected.
- Accepted payment methods include:
- EFT
- Bank Transfer
- All prices are displayed in South African Rand (ZAR) and include VAT unless stated otherwise.
- Ownership of goods remains with TM Catering Equipment and Services Pty Ltd until full payment has cleared.
- Overdue payments may attract interest in accordance with South African legislation.

Fill in your billing, delivery, and contact information accurately to ensure smooth processing and delivery. - Choose Bank Transfer Payment.
At checkout, select Bank Transfer / EFT as your preferred payment method. - Receive Our Banking Details.
Our banking details will be displayed after checkout and sent to your email together with your order confirmation. - Make Payment.
Transfer the total amount using your bank account, mobile banking app, or EFT service. Please use your Order Number as the payment reference. - Send Proof of Payment.
Email or WhatsApp your proof of payment to our sales team for faster payment verification and order processing. - Order Confirmation & Delivery.
Once payment is confirmed, we will process your order and arrange delivery or collection. You will receive updates regarding your order status.
DELIVERY AND COLLECTION
- Goods will only be released once payment reflects in the company bank account.
- Delivery typically takes between 2–5 Business Days depending on your location, stock availability, and courier schedules.
- Risk passes to the Customer upon delivery or collection.
- Customers must inspect goods upon receipt and report shortages or damages immediately.
- TM Catering Equipment and Services Pty Ltd reserves the right to refuse delivery to dangerous or high-risk areas.
- Alternative delivery arrangements or collection options may be offered where applicable.
- Delivery charges paid for undeliverable high-risk areas may be refunded.
RETURNS, EXCHANGES, AND REFUNDS
- Returns are only accepted within 7 calendar days from the date of delivery or collection.
- Returned items must:
- Be unused
- Be complete
- Be in Original Packaging
- Include the original Invoice
- Prior approval for all returns is required.
- A handling or restocking fee of up to 15% may apply.
- Refunds are processed via EFT only.
- No refunds or exchanges will be accepted after 7 calendar days.
WARRANTIES AND GUARANTEES
- Products carry either a 6-month or 12-month warranty depending on the item supplied.
- Warranties cover manufacturing defects only.
- The warranty excludes:
- Misuse
- Negligence
- Incorrect installation
- Poor maintenance
- Unauthorized repairs
- Wear and tear items
- The warranty becomes void if:
- Serial numbers are removed
- Unauthorized repairs are performed
- Non-original parts are used
- Structural modifications are made
- Defective products must be returned for inspection before replacement or repair approval.
- Transport or delivery costs related to warranty claims may be for the Customer’s account unless otherwise agreed.
PRODUCT INSTALLATION AND SAFETY
- Gas equipment must be installed by qualified professionals.
- TM Catering Equipment and Services Pty Ltd accepts no liability for damage caused by improper installation or operation.
- Refrigeration equipment warranties are subject to proper handling, installation, ventilation, and regular maintenance.
- Failure to maintain equipment properly may void warranties.
REPAIRS AND MAINTENANCE
- Repairs and maintenance must be performed by authorized technicians to maintain warranty validity.
- Repairs require the original proof of purchase.
- Assessment fees may apply for out-of-warranty inspections.
- Repaired equipment must be collected within the specified collection period, failing which storage fees may apply.
- Uncollected equipment may be sold to recover storage and repair costs after reasonable notice.
OWNERSHIP OF GOODS
- Goods remain the property of TM Catering Equipment and Services Pty Ltd until paid in full.
- No goods will be dispatched based solely on proof of payment.
PRIVACY AND DATA PROTECTION
- Personal information is processed in accordance with POPIA.
- Customer information is used only for legitimate business purposes including:
- Order processing
- Deliveries
- Customer support
- Legal compliance
- Full details are contained within the company Privacy Policy.
LIMITATION OF LIABILITY
- TM Catering Equipment and Services Pty Ltd shall not be liable for damages caused by:
- Improper use
- Incorrect installation
- Negligence
- Lack of maintenance
- The company shall not be liable for indirect damages, loss of income, or business interruption.
- Liability is limited to the value of the purchased goods.
- The company shall not be responsible for delays caused by Force Majeure events.
COMPLIANCE WITH SOUTH AFRICAN LAW
These Terms are governed by the laws of the Republic of South Africa, including:
- Consumer Protection Act
- POPIA
- VAT Act
- Companies Act
- Electronic Communications and Transactions Act
If any provision is found unenforceable, the remaining provisions shall remain valid.
DISPUTE RESOLUTION
- Customers should first contact our support team regarding disputes or complaints.
- If unresolved, disputes may be referred to mediation or arbitration within South Africa.
- South African courts shall have jurisdiction over all legal matters relating to these Terms.
TERMINATION
TM Catering Equipment and Services Pty Ltd reserves the right to suspend or terminate services or orders where the Customer breaches these Terms or fails to make payment.
NOTICES AND COMMUNICATIONS
All official notices and communications must be sent in writing via email or through the official contact details provided by the company.
GENERAL PROVISIONS
- These Terms constitute the full agreement between the Customer and TM Catering Equipment and Services Pty Ltd.
- No amendment or waiver shall be valid unless confirmed in writing.
- Failure to enforce any provision shall not constitute a waiver of rights.
- Customers may not transfer or assign rights without written consent from the company.
